Client, a foreign national in the United States on a work visa, was charged in Escambia County with Fleeing or Eluding a Law Enforcement Officer in a patrol vehicle with siren and lights activated (F.S. § 316.1935(2)), a third-degree felony carrying up to 5 years in Florida State Prison, a $5,000 fine, and a mandatory driver's license revocation. He was held in custody on an immigration detainer, meaning that resolving the criminal case would not by itself secure his release. For a visa holder, the felony was the whole case.
