Domestic Violence Allegations Are Easy to Make – Hard to Defend Alone

Domestic disputes are emotional. Arguments happen behind closed doors. When police arrive, they often see only the aftermath, not what led up to it.

  • People may be crying, angry, or intoxicated, and stories can change.

  • There may be no neutral witnesses—just two people telling different versions.

When It’s Just Their Word Against Yours

Many domestic violence cases are exactly that: two people, two stories, one set of officers trying to make sense of chaos.

But a “he said / she said” situation does not automatically equal guilt. To convict you, the State must convince a judge or jury that:

  • Your accuser’s story is consistent and believable, and

  • Any injuries, photos, or messages back up their version, and

  • Your side of the story is not enough to raise reasonable doubt.

 

A good defense looks at:

  • Inconsistencies in the accuser’s statements over time

  • The timing of the accusation (right after a breakup, custody dispute, or other conflict)

  • Whether self-defense, mutual pushing, or accidental contact has been ignored

  • Texts, calls, and social media before and after the incident

  • How much assumptions and bias influenced the officer’s decision to arrest
